COMMON ORDER

All these complaints have been filed by various complainants U/s.12 of the Consumer Protection Act, 1986 against one and same the Opposite Party (herein after referred as OP).  The issues involved in all these complaints are one and the same and the reliefs sought in each of the complaints are almost identical.  Hence all these complaints have been taken up together for disposal under this common order.

 

2. The complainants have filed these complaints for refund of the advance amount paid by each one of them towards purchase of Flats/sites together with interest, compensation and litigation cost etc., alleging deficiency of service.

 

3. The allegations made in all these complaints are almost same.  The brief averments made in all these complaints are as under:

That OP is a Company registered under the Companies Act and one Mandeep Kaur is Managing Director of the said Company.  OP is engaged in construction of apartments and development of residential layout.  That OP Company gave vide publicity regarding their various projects through celebrities in the print as well as electronic media.  That OP by their hi-tech and glittering advertisements attracted complainants and several other innocent persons who were looking for residential sites and apartments in various locations at Bangalore.  Attracted by various offers made by OP Company, complainants decided to buy sites/apartments in various projects proposed to be developed by OP Company in prime areas at different locations.  That, OP made the complainants to believe that they have either purchased or entered into memorandum of understanding with the owners of various lands upon which they proposed to develop/construct residential sites and apartments.  Some of the complainants decided to purchase residential sites in various residential layouts to be developed by OP in different names and some of the complainants decided to purchase apartments of various dimensions, according to their requirements in different apartment complex to be developed by OP.  The particulars of the advance amount paid by each of the complainants, the date of each payment, date of MOU, name of the project in which they have invested money etc., have been given in detail in the following table.

The complainants have advanced huge amounts towards purchase of sites/apartments and after receipt of the same, OP Company has entered into memorandum of understanding with complainants and also issued receipts for having received money from the complainants.  The complainants who parted with huge amount towards purchase of sites/apartments were waiting for OP to complete the project within the time stipulated in the memorandum of understanding.  However OP did not commence either the formation of any of the layouts as promised and also construction of any apartment complex.  OP also started avoiding the complainants when they began repeatedly asking them about the commencement and completion of formation of the layout and construction of apartment complex.  When OP failed to commence the formation of layout as well as construction of apartments, the complainants became suspicious about the bonafides of OP and their enquiries revealed that OP Company has neither purchased any of the lands shown to them nor entered with memorandum of understanding with the owners of any such lands.  Then the complainants insisted OP to refund the advance amount paid.  That, OP has not at all refunded any advance amount to any of the complainants despite their repeated requests.  Therefore, the complainants having felt cheated by OP have approached the jurisdictional police and lodged complaints against OP.  The jurisdictional police have registered cases against OP under various provisions of Indian Penal Code and issued FIR and now the investigation of the cases, has been taken up by CID Police, Bangalore.  Thereafter, the complainants got issued legal notice through their counsel to OP for refund of advance amount, however the legal notices so sent were returned without service, since OP had shut down their office.  Therefore, the complainants have approached this Forum for redressal.

Despite service of notices, OP failed to appear and were placed ex-parte.  Thereafter complainants were called upon to tender their evidence by way of affidavit.  Accordingly, each of the complainants have tendered their evidence by way of affidavit reiterating the allegations made in their respective complaints.  Each of the complainants have produced the copies of booking form, MOU and cash receipts to substantiate the allegations made in their complaints.

Perused the allegations made in each of the complaints, various documents produced by the complainants and other material placed on record.  The allegations made in the complaints coupled with documents produced by each of the complainants and the sworn testimony of the complainants goes to establish that, OP has lured the complainants to invest in their bogus projects and made them to part with huge advance amount knowing fully well that they are not at all able to commence or complete any one of the proposed projects announced/undertaken by them.  It appears to us that, OP has played fraud upon the complainants and cheated them and also duped them.  An inference can be drawn from the conduct of OP in remaining absent despite service of notice that they admit the claim of each one of the complainants.  We don’t have any reasons to disbelieve or discredit oral as well as documentary evidence led in by each of the complainants.

The conduct of OP in not commencing and completing any of the proposed projects and failing to refund the advance amount, when demanded, certainly amounts to grave deficiency of service.  The complainants who have invested their hard earned money for purchase of sites/apartments must have been put to great inconvenience and mental agony.  OP has absolutely no right to retain the advance amount paid by each of the complainants after having failed to commence/complete the proposed projects.  Therefore, OP has to be directed to refund the amount received from each of the complainants together with interest @ 18% p.a from the date of actual receipt till the date of realization.  Further OP has to be directed to pay adequate compensation to each of the complainants for having caused them great inconvenience and mental agony together with litigation cost of Rs.4,000/- to each one of them.

 

7. In view of the discussions made above, we proceed to pass the following:  

  

              

  O R D E R

 

The complaint Nos.960/2017, 963/2017, 964/2017, 965/2017, 966/2017, 968/2017, 969/2017, 970/2017, 971/2017, 973/2017, 974/2017, 975/2017, 976/2017, 977/2017, 978/2017, 979/2017, 980/2017, 981/2017 & 982/2017 are filed by the complainants U/s.12 of the Consumer Protection Act, 1986 are allowed in part. 

 

The OP in complaint No.960/2017 is directed to refund a sum of Rs.4,37,500/- (Four Lakhs Thirty Seven Thousand Five Hundred Only) to the complainant together with interest @ 18% p.a from the date of receipt till the date of realization.  Further OP shall pay compensation of Rs.50,000/- together with litigation cost of Rs.4,000/-.

 

The OP in complaint No.963/2017 is directed to refund a sum of Rs.3,00,000/- (Three Lakhs Only) to the complainant together with interest @ 18% p.a from the date of receipt till the date of realization.  Further OP shall pay compensation of Rs.35,000/- together with litigation cost of Rs.4,000/-.

 

The OP in complaint No.964/2017 is directed to refund a sum of Rs.6,00,000/- (Six Lakhs Only) to the complainant together with interest @ 18% p.a from the date of receipt till the date of realization.  Further OP shall pay compensation of Rs.65,000/- together with litigation cost of Rs.4,000/-.

 

The OP in complaint No.965/2017 is directed to refund a sum of Rs.4,37,500/- (Four Lakhs Thirty Seven Thousand Five Hundred Only) to the complainant together with interest @ 18% p.a from the date of receipt till the date of realization.  Further OP shall pay compensation of Rs.45,000/- together with litigation cost of Rs.4,000/-.

 

The OP in complaint No.966/2017 is directed to refund a sum of Rs.5,20,000/- (Five Lakhs Twenty Thousand Only) to the complainant together with interest @ 18% p.a from the date of receipt till the date of realization.  Further OP shall pay compensation of Rs.55,000/- together with litigation cost of Rs.4,000/-.

 

The OP in complaint No.968/2017 is directed to refund a sum of Rs.5,20,000/- (Five Lakhs Twenty Thousand Only) to the complainant together with interest @ 18% p.a from the date of receipt till the date of realization.  Further OP shall pay compensation of Rs.55,000/- together with litigation cost of Rs.4,000/-.

 

The OP in complaint No.969/2017 is directed to refund a sum of Rs.4,65,000/- (Four Lakhs Sixty Five Thousand Only) to the complainant together with interest @ 18% p.a from the date of receipt till the date of realization.  Further OP shall pay compensation of Rs.50,000/- together with litigation cost of Rs.4,000/-.

 

The OP in complaint No.970/2017 is directed to refund a sum of Rs.2,00,000/- (Two Lakhs Only) to the complainant together with interest @ 18% p.a from the date of receipt till the date of realization.  Further OP shall pay compensation of Rs.25,000/- together with litigation cost of Rs.4,000/-.

 

The OP in complaint No.971/2017 is directed to refund a sum of Rs.3,75,000/- (Three Lakhs Seventy Five Thousand Only) to the complainant together with interest @ 18% p.a from the date of receipt till the date of realization.  Further OP shall pay compensation of Rs.40,000/- together with litigation cost of Rs.4,000/-.

 

The OP in complaint No.973/2017 is directed to refund a sum of Rs.3,50,000/- (Three Lakhs Fifty Thousand Only) to the complainant together with interest @ 18% p.a from the date of receipt till the date of realization.  Further OP shall pay compensation of Rs.40,000/- together with litigation cost of Rs.4,000/-.

 

The OP in complaint No.974/2017 is directed to refund a sum of Rs.4,50,000/- (Four Lakhs Fifty Thousand Only) to the complainant together with interest @ 18% p.a from the date of receipt till the date of realization.  Further OP shall pay compensation of Rs.50,000/- together with litigation cost of Rs.4,000/-.

 

The OP in complaint No.975/2017 is directed to refund a sum of Rs.2,00,000/- (Two Lakhs Only) to the complainant together with interest @ 18% p.a from the date of receipt till the date of realization.  Further OP shall pay compensation of Rs.25,000/- together with litigation cost of Rs.4,000/-.

 

The OP in complaint No.976/2017 is directed to refund a sum of Rs.2,00,000/- (Two Lakhs Only) to the complainant together with interest @ 18% p.a from the date of receipt till the date of realization.  Further OP shall pay compensation of Rs.25,000/- together with litigation cost of Rs.4,000/-.

 

The OP in complaint No.977/2017 is directed to refund a sum of Rs.4,92,000/- (Four Lakhs Ninety Two Thousand Only) to the complainant together with interest @ 18% p.a from the date of receipt till the date of realization.  Further OP shall pay compensation of Rs.50,000/- together with litigation cost of Rs.4,000/-.

 

The OP in complaint No.978/2017 is directed to refund a sum of Rs.2,60,000/- (Two Lakhs Sixty Thousand Only) to the complainant together with interest @ 18% p.a from the date of receipt till the date of realization.  Further OP shall pay compensation of Rs.30,000/- together with litigation cost of Rs.4,000/-.

 

The OP in complaint No.979/2017 is directed to refund a sum of Rs.4,37,500/- (Four Lakhs Thirty Seven Thousand Five Hundred Only) to the complainant together with interest @ 18% p.a from the date of receipt till the date of realization.  Further OP shall pay compensation of Rs.50,000/- together with litigation cost of Rs.4,000/-.

 

The OP in complaint No.980/2017 is directed to refund a sum of Rs.6,00,000/- (Six Lakhs Only) to the complainant together with interest @ 18% p.a from the date of receipt till the date of realization.  Further OP shall pay compensation of Rs.65,000/- together with litigation cost of Rs.4,000/-.

 

The OP in complaint No.981/2017 is directed to refund a sum of Rs.2,60,000/- (Two Lakhs Sixty Thousand Only) to the complainant together with interest @ 18% p.a from the date of receipt till the date of realization.  Further OP shall pay compensation of Rs.30,000/- together with litigation cost of Rs.4,000/-.

 

The OP in complaint No.982/2017 is directed to refund a sum of Rs.3,62,500/- (Three Lakhs Sixty Two Thousand Five Hundred Only) to the complainant together with interest @ 18% p.a from the date of receipt till the date of realization.  Further OP shall pay compensation of Rs.40,000/- together with litigation cost of Rs.4,000/-.

 

OP shall comply the said order within four weeks from the date of communication of the order.

 

Furnish free copy of this order to both the parties.
