The Complainant and the 1st opposite party represented. The 2nd opposite party called absent. No oral evidence for the parties. Ext. A1 series and B1 were marked on the side of the complainant. Heard the Learned counsel for the complainant and the 2nd opposite party.
2. This complaint is filed by the complainant seeking direction against the opposite parties to issue LPG connection and also to pay a compensation of Rs. 5,000/-. The 1st opposite party filed their version stating that the 2nd opposite party failed to forward the list of applicants to the 1st opposite party and so they are not in a position to issue fresh gas connection to the consumers/new applicants. The 1st opposite party stated in their version that they are prepared to issue fresh connection to the new applicants provided the 2nd opposite party submits the list of new applicants.
3. Exbt. A1 goes to show that the complainant had submitted application for LPG connection on 09-01-2012 to the 2nd opposite party. In furtherance of the said application the 2nd opposite party collected KYC form along with relevant documents for proof of identity and proof of address on 17-05-2013.
4. It is surprising to note that in spite of the receipt of application and relevant documents, or the 2nd opposite party failed to forward the same to the 1st opposite party, for further processing. The above conduct of the 2nd opposite party amounts to deficiency in service.
5. The 1st opposite party in their version expressed their willingness to process the applications and to issue LPG connection provided the 2nd opposite party submits the relevant details.
6. In the result, we pass the following orders.
i. The 2nd opposite party shall forward the applications to the 1st opposite party including that of the complainant immediately on receipt of this order.
ii. The 1st opposite party shall process the said applications to be
submitted by the 2nd opposite party as per norms.
iii. The 2nd opposite party shall also pay Rs. 5,000/- to the
complainant towards compensation for the sheer deficiency in
service on their part within 30 days from the date of receipt of a
copy of this order failing which the above amount shall carry
interest @ 12% p.a. till realization.
The above order shall be complied with in line with the above
direction.
