None present for the appellant. Adv. Smt. S.W. Deshpande is present for the respondent and she submitted that the appeal has become infructuous as amount under impugned order has been disbursed. As this matter is received on transfer from Mumbai Commission, Notice issued by this commission on 25/03/2013 to the appellant on their address given in the appeal memo, but no report about service of notice is received. On perusal of the office copy of the notice it reflects that it was issued on the correct address as shown in the appeal memo as well as in complaint. Therefore it will have to be presumed that the Appellant is served with notice. But none appeared for the appellant. On last date also none had appeared for the appellant. Hence the appeal deserves to be dismissed in default. Appeal be recalled at end of the board.

The matter is recalled at end of the board today. Presently also none appeared for the appellant. Hence the appeal is dismissed in default.
