Complainant in person is present and submits his case.

Upon considering his submissions and on perusal of the entire materials on record it appears that the complainant has received the premium amount deposited to the O.P after a lapse of some period .

Under such circumstances , complainant filed this case with the prayer content in the prayer portion of the ptn .

But it appears from the record that the amount claimed in the prayer is not in conformity with the terms and condition as laid down in the policy issued by O.p . Besides , as soon as the complainant received the amount of premium earlier deposited with O.p before filing the instant case without rights and prejudices with the contention in this regards , then and the only the relationship between the complainant & O.p ceases as consumer & service provider .

In view of the above finding s this Forum holds that the instant case cannot be adjudicated before this Forum in the light of the Consumer Protection Act, 1986.

Hence the instant complainant case is rejected .
