O R D E R
The case of the Complainant is that on 08-08-2013 the Complainant deposited Rs.30/- in the office of the Opposite Party and obtained money receipt for resident certificate. Accordingly RMC No. 13854/13 was registered by the O.P. The Complainant approached the O.P several times but no body listen to him as a result of which he was harassed physically, mentally and financially due to negligence of the Opposite party in issuing the resident certificate . The Complainant was deprived to participate various recruitment which amounts violation of law and deficiency in service on the part of the Opposite Party. For which he has filed this Complaint for a direction to the O.P to issue the resident certificate along with compensation of Rs.1, 00000/- with litigation cost for his mental agony and financial loss.

The Case of the Opposite Party as per his version is that after institution of RMC case No. 13854/13 the R.I , Daringibadi vide his letter No. 5139/27-08-2013 submitted his enquire report stating that there was Fake certificate case No.102 pending against the father of the Complainant and no report was submitted regarding his residence . The Ex- Tahasildar Daringibadi has written “Vigilance” on the right hand top corner of the order sheet for which no action was taken in the matter. On receipt of the notice from the Forum the case record was put–up before the Additional, Tahasildar, Daringibadi who directed the R.I Daringibadi to submit his enquire report on the residence of the applicant. On receipt of the said report from R.I, Daringibadi the resident certificate has been signed by the Additional Tahaisldar and the said certificate was submitted by the O.P before the Forum.
This complaint was received from the Complainant through Registered post. The Complainant was not attending this Forum in spite of getting notice .We have heard the O.P and perused the document filed by both the parties. The Complainant claimed compensation of Rs. 1, 00000/- for the deficiency in service of the Opposite Party. As per settled principle of law the payment for miscellaneous expenditure at the time of applying for any certificate to the revenue authorities is for the purpose of augmentation of the revenue of the state and there is no element of service connected therewith. On the above facts and circumstances the Complainant is not a Consumer for which we are not granting any compensation in favor of the Complainant. However the Complainant is entitled to get the resident certificate which is filed by the O.P in the case record. Accordingly the complaint is allowed in part.
