          This is a complaint filed u/s 12  of Consumer Protection Act, 1986 for directing the Opposite Party to repay the sum of Rs.2,35,397/- the ecess amount received by him from the complainant for the construction of the building with interest at the rate of 12%per annum;  to pass an award of Rs.1.50 lakhs as compensation for the deficiency of service committed by the opposite party, in not executing the contract as per agreement dated 22.04.2013; to pass an award of sum of Rs.50,000/- towards the mental agony and depression incurred for the complainant in not executing the contract by the OP and to pay a sum of Rs.10,000/- towards cost of this complaint.        

          2. Notice to the opposite party was duly served.  The opposite party appeared through Counsel and filed reply version.  Hence, the matter was posted for complainant's side evidence. 

          3. Today this complaint was called.  Complainant and Counsel present.  OP and Counsel absent.  Complainant endorsed in the complaint that he is not willing to proceed the matter further and prayed for dismissal.  Hence, this complaint is hereby dismissed as not pressed.
