11.There is no dependable evidence from the side of the Ops that the spare parts were not available in the local market and that immediately they placed order for such spare parts to the manufacturers and thus delay occurred. Of course, in Ex. B-  

12.In the result, the Appeal is partly allowed and the opposite parties are directed to hand over the defect free subject vehicle.
