  1. The case of the Complainant is that the Complainant has opened a saving bank account on dtd. 14.8.2009 and regularly maintaining the said account through different transaction. On dtd. 1.4.2017 the statement of account of the pass book reflects that there was balance amount of Rs. 9,524.87p. On dtd. 6.7.2017 which is the next transaction of deposit, an amount of Rs. 9,500/- was deposited in the said account vide Deposit Voucher issued by the branch in favour of the Complainant by the cashier of the branch Syndicate Bank, which was the branch of operation of bank transaction during that time and subsequently after the amalgamation of the Syndicate Bank branch to Canara Bank, the statement of account has been issued by the Canara Bank related to the Syndicate Bank. Instead of crediting the amount of Rs. 9,500/-, the statement of account of the passbook of the saving account reflects that a sum of Rs. 9,500/- has been debited from the account leaving an amount of Rs. 119.84p. as balance and the credit column of the statement of account shows that Rs. 0.00 amount has been credited. Subsequently after the balance of Rs. 119.84p being minimum amount attracting an amount of Rs. 48/- has been debited as per statement of account and subsequently on dtd. 31.10.2017, the account was debited Rs. 30.08p resulting zero balance in the said account. In due course of time the Complainant shifted to Cuttack and requested the branch to transfer her saving bank account to Market Nagar Branch, Cuttack. When she enquired at Market Nagar Branch, Cuttack, they said that the account was closed. Instead of adding to the previous balance of Rs. 9,619.84p and making the balance in total Rs.19,119.84p, the balance became Rs. 119.84p, which smacks serious negligence, inefficiency, deficiency in service to the Complainant, for which the Complainant is running from pillar to post, but the OP is behaving in a rude and unprofessional manner to the Complainant with a note of closure of account due to zero balance. So it is a clear case of deficiency of service on the part of the OP.
  2. The OP is set-exparte.
  3. Perused the submission of the Complainant and records available it is found that mistake has been done byy the OP that instead of adding to the previous balance of Rs. 9,619.84p and making the balance in total Rs.19,119.84p, the balance became Rs. 119.84p and subsequently after the balance of Rs. 119.84p being minimum amount attracting an amount of Rs. 48/- has been debited as per statement of account and also  on dtd. 31.10.2017, the account was debited Rs. 30.08p resulting zero balance in the said account and thereafter the OP closed the account due to zero balance for which the Complainant sustained heavy financial loss due to negligence and deficiency in service of the OP. Due to wrong entry the Complainant harassed and it amounts to deficiency in service.

Accordingly it is ordered.

ORDER

The O.P is directed to regularize the saving bank account of the Complainant bearing A/C No. 80602010005948 and to transfer her said saving bank account to Market Nagar Branch, Cuttack by making their internal communication , to pay Rs. 50,000/- towards deficiency in service , mental agony and suffering as compensation and Rs. 10,000/- towards litigation expenses to the Complainant within 30 days from the date of this Order failing which the amount will carry interest @ 9% per annum till realization.

Order pronounced in the open Court today on 12th day of Feb, 2024.
