Counsel for the parties are agreed that the impugned order passed by the State Commission cannot be sustained, the same be set aside and the case be remitted back to the State Commission for a fresh decision in accordance with law.

          In view of the statement made by the counsel for the parties, the impugned order is set aside.  The case is remitted back to the State Commission to decide it afresh in accordance with law.

          Parties through their counsel are directed to appear before the State Commission on 09.05.2012.

Since it is a very old case, we would request the State Commission to dispose of the appeal as expeditiously as possible and preferably within a period of four months within a period of four months from the date of appearance.
