This complaint filed under section 12 of Consumer Protection Act 1986 and stood over to this date for consideration and this Commission passed the following order.

2.       This is a complaint filed by the complainant against the opposite parties alleging deficiency in service on the part of the opposite parties. The opposite party entered appearance and filed written version denying the allegation of deficiency in service raised by the complainant against the opposite parties. When this case came up for consideration today counsel for the complainant reported that he has already relinquished his vakalath as there is no instructions from the complainant.  Though the complainant filed chief affidavit on 30.01.2020, the complainant has failed to appear before this Commission to mark the documents produced by him or to face cross examination. As such there is no material evidence available before this Commission to substantiate the allegation of deficiency in service raised by the complainant against the opposite parties. Hence we find that the complainant has miserably failed to establish his case. In the above circumstances we find that this is a fit case to be dismissed.

               In the result, the complaint is dismissed. There will be no order as to costs.     A copy of this order as per the statutory requirements be forwarded to the parties free of charge and thereafter the file be consigned to the record room.
