R.K.BISHNOI, JUDICIAL MEMBER:

           

1.      As per order dated 03.05.2018 cost has been paid by the counsel for the appellant, so ex-parte order dated 12.08.2013 be deemed as set aside.  Impugned order dated 05.04.2016 be also deemed set aside and the case is remanded back to District Consumer Disputes Redressal Forum, Narnaul (In short “District Forum”) to afford an opportunity to the appellant-opposite party No.2 to file written statement and produce evidence and thereafter decide the case on the merits at the earliest.

2.      The parties are directed to appear before the District Forum on 06.07.2018.

3.      Statutory amount of Rs.25,000/- deposited at the time of filing the appeal be refunded to the appellant against proper receipt and identification in accordance with rules.
