First of all, the case was filed before the District Forum.  It was dismissed as withdrawn and filed before this Commission.

          Arguments heard at length.

          It is a case filed for flat of a Director of M & D. Infrainvestment Pvt. Ltd.  We have invited the attention of the learned counsel for the complainant towards the judgment in Pharos Solutions Pvt. Ltd. Vs. Tata Motors Ltd. and Ors., consumer complaint No. 306 of 2014, decided on 1.9.2014, which was approved by the Supreme Court.

Learned counsel for the complainant wants to withdraw this complaint and wants to file it before the appropriate forum/civil court.  The complaint is dismissed as withdrawn.  Court fee already paid be returned by Registrar to the complainant.  So far as point of limitation is concerned, he can take benefit of the decision rendered in Laxmi Engineering Works vs. P.S.G. Industrial Institute (1995) 3 SCC 583.
