Mr. Santanu Mukherjee, Ld. Advocate appears for the judgment debtor.

Ld. Advocate of the decree holder is present along with his client.

Part payment of the decreetal amount is made by the Ld. Advocate of the judgement debtor in demand draft bearing No. 296952 dated 24.01.2023. Payment of Rs. 1,50,000/- has been mentioned in the demand draft.

The demand draft is handed over to the decree holder in presence of his Ld. Advocate after rataining a copy of the same for the purpose of this record.

The Ld. Advocate of the judgement debtor files an application for recall of the warrant which are pending execution as against his client.

The application is registered as MA/35/2023.

After hearing the Ld. Advocates on both sides and adverting to the MA we find to say that the prayer of the judgement debtor may be provisionally allowed.

The warrant issued against the judgement debtor will be kept at abyeance until further order.

The MA being No. 35/2023 is thus disposed off.

Send a copy of this order to the Ld. Advocate of the judgement debtors for communication to the P.S. Concerned.

Ld. Advocate of the judgement debtor is directed to ensure the payment of the balance amount by the next date.
