Sri Satish Chandra Srivastava, learned Counsel for the revisionist appeared.
I have heard learned Counsel for the revisionist and perused impugned order dated 27-04-2019 passed by District Consumer Forum, Gorakhpur in Complaint Case No. 197 of 2017 Sunita Devi V/s M/s Life Diagnostic Centre whereby opportunity of written statement has been closed.
It is contended by learned Counsel for the revisionist that the respondent/opposite party has moved an application before District Consumer Forum for providing papers relating to averments made in para 4 of complaint but the papers prayed were not supplied and the opportunity of written statement was closed.

I have considered the submission made by learned Counsel for the revisionist.
Considering the judgment of Hon’ble Apex Court rendered in the case of Civil Appeal No…….of 2017 (D. No. 2365 of 2017) Reliance General Insurance Company Limited and another V/s M/s. Mampee Timbers and Hardware Pvt. Ltd. and another the revision petition is disposed of finally with liberty to the revisionist/opposite party to submit written statement alongwith application for condoning delay of written statement before District Consumer Forum. If the written statement is submitted by revisionist/opposite party within 30 days from today before District Consumer Forum alongwith delay condonation application, the District Consumer Forum shall pass appropriate order keeping in view the judgment of Hon’ble Apex Court rendered in the case of Civil Appeal No…….of 2017 (D. No. 2365 of 2017) Reliance General Insurance Company Limited and another V/s M/s. Mampee Timbers and Hardware Pvt. Ltd. and another.
Let copy of this order be made available to the parties positively within 15 days as per rules.
