Petition was filed on 07.05.2010. The complainant had taken a dish TV connection of the Sun direct of Ist opposite party from the second opposite party by paying an amount of Rs.1999/- on 26.01.2008. At the time of installation Opposite Party has assured that the monthly charges of Rs.75/- will be collected after one year only. When the complainant approach the Opposite Party on 27.01.2009 to recharge the coupon of Rs.75/-, Opposite Party had stated that there is no 75/- rupees recharge coupon and complainant was requested to take recharge coupon of Rs.100/- and assured to adjust the balance amount in the next monthly installments. Against this promise of Opposite Party they had enhanced the monthly charge from Rs.75/- to Rs.110/- without any information to the complainant. On 03.05.2010 complainant had entrusted Rs.110/- with opposite party No.3 to recharge. But by 3.o’Clock in the evening Opposite Party had disconnected the channels to the complainant. The complainant is alleging deficiency in service on the part of Opposite parties and also unfair trade practice was been done by the opposite parties. Service to the complainant was disconnected and when he enquired about the matter he did not get any definite reply. Hence this petition seeking relief from the opposite parties. Notice was sent to opposite parties 1 to 3. Opposite Party 3 appeared in person and stated that the only thing he has done is to recharge the coupon. Opposite Party 1 & 2 are the parties to give service to the complainant. Opposite Party 1 & 2 did not appear before the forum even though the notice was served. Subsequently none of the Opposite parties appeared before the forum or filed any version. Hence Opposite Party 1,2, &3 were called absent and set exparte. The complainant had filed affidavit and Ext.A1 to A3 were marked on complainant’s side. From the Exts. and the evidence of the complainant the case of the complainant is proved. Ext.A1& A2 shows different attractive offers given by the opposite parties through their advertisements.Ext.A2 shows that there was a special offer of SUN Direct with one full year subscription of Rs.1999/- . The complainant had availed this offer of the Opposite Party up to 27.01.2009. After 27.01.09 when the complainant approached the Opposite Party for recharging the coupon the opposite party had enhanced the monthly remittance and subsequently the complainant could not view the channel as the programmes were cut by the opposite parties. This act of the opposite parties of not giving the proper service after giving attractive offers and persuading customers to get the connections is unfair trade practice. Going through the evidence and records we are of the opinion that opposite parties failed to give efficient service to the complainant. Hence the complainant is entitled to get a compensation for the negligent and deficient act of the opposite parties. In the result petition is allowed and opposite parties 1 & 2 are directed to pay a compensation of Rs.1000/- to the complainant along with a cost of Rs.500/-. After paying the amount Opposite Party 1 & 2 can take back the system given to the complainant. Ops 1& 2 are directed to comply the order within one month of receiving the copy of the order.
