           Record is put up today by the put up petition of the complainant as well as O.p.

          On petition is filed by the complainant himself praying for withdrawal of the case alternatively, for an order showing dismissal of the case for non-prosecution on the grounds stated therein.

          On behalf of O.p. one authorized letter is filed engaging Mr. Arun Singh to look after the present case on behalf of the O.p.

          This record has been slated on 21/05/2021 and accordingly record need not be put up on 21/05/2021 as this Commission is taking up the petition in question of complainant today.

Complainant himself submits that a compromise has been effected in between the parties and outside this commission and he does not want to proceed further anymore and accordingly prays for an order for withdrawal of the case or an order resulting in dismissal of the case for non-prosecution.

          On behalf of the O.p.-Mr Arun Singh echoed the same view and submits that let an appropriate order may kindly be passed.

          In view of the above scenario and considering the attending facts and circumstance of the case and specially when complainant himself is praying for an order in the form of withdrawal or dismissal for non-prosecution, this Commission will not stand otherwise and thus, it is hereby

o r d e r e d

that the instant case is dismissed for non-prosecution with the observation that in future complainant is totally debarred from filing any fresh case on self-same cause of action.
