       Ld. Advocate of Petitioners/O.p. nos.1 & 2 is present Ld. Advocate of O.p. nos.3 to 5 is present.  Ld. Advocate of O.p./complainant is also present. Instant M.A. case is taken for hearing. Heard the Ld. Advocate of the Petitioner/O.p. nos.1 & 2 and Ld. Advocate of O.p./complainant in full.

       It is alleged in the said petition of the petitioners that Petitioner/O.p. no.2 had already shifted from the address mentioned in the original petition of complaint in C.C. case No.194/2022 and by making annexure petitioners files one copy of document.

       Ld. Advocate of the petitioners submits that O.p./complainant may be directed to file amended complaint in view of the changing of complaint of petitioner/O.p. no.2.

       Ld. Advocate of O.p./complainant has vehemently opposed the submission advanced by the Ld. Counsel of the petitioners/O.p. nos.1 & 2 and contended that when Petitioners/O.p. nos.1 & 2 know all such facts they did not come forward in advance which means knowingfully well they tried to kill/waste the time and to harass the O.p./complainant and it is crystal clear that from the very beginning entire fact regarding this case instituted by the O.p./complainant are within knowledge of Petitioner/O.p. nos.1 & 2 and as such instant case is liable to be dismissed.

       Considering the entire scenario we find merit and force in the submission of Ld. Counsel of O.p./complainant and considering the materials on record we are of the view the instant M.A. case is liable to be dismissed of contest. Accordingly we do that.
