O R D E R
The case of the Complainant in short is that he had availed two Electricity connections in his name for domestic purposes vide Consumer No. 2921010090082 & 2921010090055. On 22-11-2012, the Opposite Party No.2 along with his team inspects the premises of the petitioner and noticed that one connection vide No. 2921010090082 has been used unathorisedly. After that on 29-11-2012 a notice was issued to the Complainant along with a bill amounting Rs. 15801/- charged for a period of 18 months as per G.P Tariff rate. After getting this notice the Complainant sent his objection to the O.P No.2 on 03-01-2013 by registered post with A.D but no action was taken by the Opposite Party No.2. Subsequently he has received the bill of January 2013 in connection with the Consumer No. 292101090082 amounting Rs. 16,380/-showing an amount of Rs.15,949,13 paise as arrear. As Rs. 15,801/- was charged against the Complainant in the said bill illegally, he has filed this complaint against the Opposite Parties for a direction to Opposite Party No.1 to receive bill as per monthly consumption except the disputed amount of Rs. 15,801/- as he had not used the concerned house for commercial purpose .
-2-
The Opposite Parties have not appeared in this case in spite of getting notice from the Forum. Hence, both the Opposite parties were set exparte. No version was filed by them.
We have heard the learned counsel of the Complainant. Perused the complaint petition and the copies of the documents filed by the Complainant. There was no specific allegation regarding the commercial use of the house alleged in the meter inspection report dated. 22-11-2012 supplied to the Complainant. Hence, we allow the Complainant to the extent that this case is not coming under 126 (2) of electricity Act 2003. Accordingly the complaint is allowed exparty against the opposite parties. The Opposite Party No.1 is directed to receive the bill amount as per monthly consumption of the Consumer except the disputed amount of Rs. 15,801/- . The Opposite Parties are further directed to revise the bill of the month of January 2013 as far as disputed amount of Rs. 15,801/- is concerned within 30 days from the receipt of this order. The interim order passed on 28-02-2014 is hereby vacated .
The C.C is disposed of. Supply free copies of this order to both the parties.
