Notice was issued to respondent no.1 on 17.2.2014. AD Card has not been received back. Since, more than 30 days have lapsed, respondent no. 1 shall be deemed to have been served. Vide impugned order dated 4.1.2013, passed by the State Commission, appeal of the petitioner filed before the State Commission was dismissed as none was present on behalf of the petitioner. It would be pertinent to point that on behalf of the respondents also none was present. For the reasons mentioned in the present revision petition, same is allowed and impugned order is set aside, subject to payment of Rs.5,000/- (Rupees Five Thousand only) as cost and matter is remanded back to the State Commission to decide the case afresh, in accordance with provisions of law, after giving opportunity of hearing to all the parties. Cost be deposited by way of demand draft in the name of onsumer Legal Aid Account of this Commission, within four weeks Present petition stand disposed of accordingly. Parties are directed to appear before the State Commission on 08.5.2014. Dasti to all the parties.
