The case is fixed for argument.
After hearing argument from both sides the Commission proceeds to dispose of the case as hereunder: -
The Complainant’s case is that he applied for electric connection to his Submersible Pump (SMP) connection with O.P. and deposited Quotation amount of Rs. 33,451/-, dt.09/12/2013. Having failed to get the above connection the Complainant applied further for short term connection which was effected on 16/03/2017 vide Consumer I/D No.202254810. The Complainant has approached this Commission for getting refund of Quotation money of the previously applied connection with further prayer not to disconnect the existing SMP electric connection for non-payment of outstanding dues (OSD).
O.P. contested the case by filing a written version admitting therein that they are ready and willing to refund the Quotation amount of Rs.33,451/- subject to production of original money receipt. But the O.P. has disconnected the short term SMP connection on 23/12/2020 for non-payment of outstanding dues amounting to Rs.58,688/- with LPSC Rs.68,153/-.

-: Decision with reasons: -
Having regard to the facts of the case, submission, contention and documents on both sides the Commission finds that the Complainant is entitled to get refund of Rs.33,451/- subject to production of original money receipt as no money receipt is on record in support of the aforesaid payment on 09/12/2013. Prayer for imposition of penalty does not arise as no electric connection was installed in response to the earlier application.
Admittedly the Complainant has so long been enjoying short term SMP connection but he has defaulted the payment of OSD of Rs.58,688/- with LPSC Rs.68,153/- as on 04/09/2023 for which the electric connection has been disconnected. Without payment of OSD with LPSC the Complainant cannot enjoy the electric connection and there cannot be any deficiency in service on the part of the O.P. to disconnect the electric connection in such case.
Accordingly it is ordered…….
that the case be and the same is disposed of on contest by directing the O.P. to refund Rs.33,451/- to the Complainant subject to production of original money receipt with further direction upon the Complainant to deposit the OSD with LPSC raised from time to time to avail of free and regular electric supply to his SMP connection keeping in view that the up to date LPSC should not exceed Rs.50,000/-
Both parties be supplied copy of this order free of cost.
