The case is fixed for argument.
After hearing argument from both sides the Commission proceeds to dispose of the case as hereunder:-
The Complainant’s case is that he has a Submersible Pump (SMP) connection with O.P. vide Meter No.RSXB52703 for which materials were supplied by the Complainant for Rs.45,788/- as per terms and condition of the Quotation dated: 10/12/2010. The Complainant has claimed Low Tariff rate as per T.O.D. connection till the month of July, 2019 by adjustment of Rs.1,31,906/-. The Complainant has approached this Commission for appropriate relief.
O.P. contested the case by filing a written version contending inter alia that T.O.D. connection has been installed w.e.f.07/02/2019 and electric bill is generated accordingly and the Complainant has Outstanding Dues (OSD) of Rs.1,54,146/- without LPSC and the instant case has been filed to avoid such OSD.

Having regard to the facts of the case, submission, contention and documents on both sides the Commission finds that the SMP connection has been installed on Turn Key basis where materials are to be supplied by the Complainant amounting to Rs.45,788/- which is therefore not refundable according to the terms and condition. Low Tariff rate is applicable when TOD meter is installed and so the Complainant cannot get any adjustment of Low Tariff rate prior to the installation of TOD meter on 27/02/2019. The Complainant has failed to make out any case in his favour to get any relief as prayed for, on the contrary he has an outstanding dues of his SMP connection.
It has brought to the notice of the Commission that the Complainant tried to get relief by filing a pre-litigation case before SDLSA, Bishnupur on false representation of filing a similar case before this Commission No. being C.C.12/2022 which case is on inspection not found to be pending before this Commission. The Commission takes exception to such mala fide act and conduct of the Complainant in getting undue relief from the Authority concerned.
With this observation the case is disposed of on contest by directing the Complainant to clear the outstanding dues raised from time to time by the O.P. otherwise he will face legal consequences in accordance with the Electricity Act.
