Both parties file hazira through Advocate.

The case is fixed for filing written version but no W.V. is filed by the O.P. even after expiry of statutory period.

The case is therefore taken up for ex-parte hearing.

The Complainant’s case is that he is a consumer under O.P. No. being ID 232056856 with Meter No.G210930. Initially the meter was defective and it was replaced by a new meter no. being L4433466 on 08-06-2015 and thereafter electric bill dated: 21-07-2015 was sent for Rs.9,884/- for the Month of July, 2015 to August, 2015 but the previous bills from January, 2015 to June, 2015 were at Rs.580/- per month.

The Complainant has therefore approached this Commission for appropriate relief.

The Commission has perused the complaint case and all the relevant documents on record in comparison to the bills for the previous two quarters for the year 2015. The electricity was charged at Rs.580/- on an average but in no case in the 3rd quarter for the same year from July to September the bill amount cannot be 9884.46 as demanded by the O.P.. It is the rule of the Electricity Act that whenever discrepancy arises average consumption of previous six months should be taken into consideration but the O.P. has failed to do so in this case. The O.P. cannot raise the disputed bill more than Rs.1,740/-.

Prima facie case of the Complainant is established.                                                                                                                                        

Hence it is ordered……

That the case be and the same is allowed Ex-parte against the O.P.

The O.P. is directed to send revised bill for July to September, 2015 at Rs.1,740/- and on receipt of the revised bill the Complainant will pay the same within three months thereof.

Both parties be supplied copy of this Order free of cost.
