Both parties file hazira through Advocate.

The case is fixed for argument.

After hearing argument from both sides the Commission proceeds to dispose of the case as hereunder: -

The Complainant’s case is that he is a consumer under O.P. having Submersible Pump (SMP) connection Consumer I/D No. being 233243702 and at the time of installation of the connection the complainant paid Rs.48,671/- by supplying the materials required for the same which has not yet been adjusted. The complainant received an electric bill dated: 18-09-2018 for Rs. 1, 05, 283/- out of which he has already paid Rs.80, 000/- on different dates. The complainant has therefore prayed for relief for adjustment of money already paid.

The O.P. contested the case by filing written version denying all the material allegations made in the complaint admitting the receipt of payments of Rs. 80,000/- on different dates but contending inter alia that the complainant is to pay the bill dated: 18-09-2018 without any adjustment.

-: Decision with reasons:-

The Commission has gone through the respective case of the parties and the documents placed before the Commission. Admittedly the complainant has paid Rs.80, 000/- on different dates and Rs.48,671/- as the cost of materials supplied by him but the complainant has not got any adjustment of those two payments against the bill dated: 18-09-2018 for Rs.1,05,283/-.

The complainant is still to get refund for Rs.23, 388/- [(Rs.80, 000 + 48,671/-) minus Rs.1, 05, 283] from the O.P. which may be adjusted against the current electric bill(s). The case therefore succeeds.

Hence it is ordered……..

That the case is disposed of by directing the O.P. to adjust Rs.23, 388/- against the current electric bill and restore electric connection if disconnected in the mean time for non-payment of electric bills.

Both parties be supplied copy of this Order free of cost.
