          Petitioner/complainant, who is Principal Officer of Akhil Bhartiya Upbhokta Congress, had to travel from Delhi to Bhopal on 23.12.2002 but the flight got delayed inordinately by 6 hours.  According to the complainant, no announcement regarding delay was made till 7.30 PM nor any information was conveyed on his mobile phone.  Petitioner, aggrieved by the action/inaction of the respondent, filed a complaint before the District Forum.

 

          District Forum allowed the complaint and directed the petitioner to pay a sum of Rs.5,000/- as compensation and costs of Rs.1,000/-.  Respondent was directed to pay the amount within one month failing which the awarded amount was to carry interest at the rate of 18%.

 

          Not satisfied with the order passed by the District Forum, petitioner as well as the respondent filed the appeals.  Appeal filed by the petitioner/complainant was dismissed and that filed by the respondent was allowed.  Order of the District Forum was set aside and the complaint was ordered to be dismissed.

 

          Without going into the merits of the dispute, on a suggestion made by Mr.Lalit Bhasin, counsel for the respondent, we dispose of this Revision Petition with a direction to the respondent to make an ex gracia payment of Rs.10,000/- to the petitioner/complainant.  Mr.Bhasin assures that the sum of Rs.10,000/- shall be paid to the petitioner within 4 weeks.
