 ORDER                                          

  1. The instant complaint is filed by Ranjit Kaur and others (hereinafter referred to as the complainant) against State Bank of Patiala (hereinafter referred to as the OP/s) under the Consumer Protection Act ( for short the Act).
  2. The averments of the complainant are as follows:
  3. That complainants are the legal heirs of deceased Chanan Singh who was died in an accident on 13.3.2017. Said Chanan Singh was availing the services of the OP by way of holding an account No.55067029638 .
  4. Chanan Singh was employed in Punjab State Power Corporation Lgd.as an Assistant Lineman and opened his salary account in the branch of OP. It is alleged that OP offered a Personal Accidental Death Policy to the tune of Rs.5,00,000/- to Chanan Singh on the usage of ATM cum debit card and accidental death of the card holder, which was accepted by Chanan Singh and OP issued ATM cum Debit Card to him .  that on 13.3.2017 while Chanan Singh was on duty, he expired due to sudden electric shock. After his death complainants approached OP to recover the amount and other dues and also to close the account of Chanan Singh. Relevant documents were handed over to the OP who assured that it will take some time. In the month of May,2017 complainants again visited the OP to know about the status of their claim but no satisfactory response was given to them. They also wrote request letter dated 15.5.2017 in this regard but the same was refused, which amounts to deficiency in service on the part of OP. Consequently, prayer has been made for acceptance of complaint.
  5. Notice sent to the OP through registered post not received back un-served. It was assumed that the OP was served but did not appear and contest the complaint and was accordingly proceeded against ex-parte.

In ex-parte evidence ld. counsel for the complainants tendered Ex.CA affidavit of Smt.Ranjit Kaur, Ex.CB affidavit of Sh.Sukhjinder Singh, Ex.C1 copy of ration card, Ex.C2 copy of passbook, Ex.C3 copy of account statement,Ex.C4 copy of ATM card, Ex.C5 copy of DDR,Ex.C6 death certificate,Ex.C7 copy of request letter and closed evidence.
  7. We have heard ld. counsel for the complainants and have also gone through the record of the case, carefully.
  8. The allegation of the complainants are that the OP did not release the amount of Personal Accidental Claim on the usage of ATM cum debit card.
  9.  We have carefully gone through the record of the case. There is no such Policy or terms and conditions as alleged by the complainant, placed on the file by the complainants. Ex.C2 is the copy of pass book, issued in the name of Chanan for the account maintained by him with the OP, Ex.C3 is the copy of statement of account showing the transactions made, Ex.C4 is the copy of  ATM cum debit card issued by the OP.
  10. As such the complainants failed to prove their case and are not entitled for any claim. Thus, finding no merit in the complaint, we dismiss the same accordingly. Parties are to bear their own costs.  
  11.           The instant complaint could not be disposed of within stipulated period due to Covid protocol and for want of Quorum from long time.
