ORDER / JUDGEMENT

Hazira is filed on behalf of the Complainant through Advocate.

Step is taken on behalf of the O.P. No.1/SBI, Bankura Branch through Advocate.

No step is taken by O.P. No.2 (Bajaj Finance Ltd.)

On the prayer of both sides the case is disposed of as hereunder: -                                                                                                                 

The Complainant’s case is that his wife has a Savings bank account No.86888685314 with O.P. No.1 and she took loan from O.P. No.2 under loan Agreement 4D4CDD70756902, dt.10-04-2018. After full and final settlement of the loan Account the O.P. issued N.O.C. dated:14-12-2018 but O.P. No.1 deducted a sum of Rs.295/- on 14-07-2019 from the above mentioned account of the Complainant’s wife without having received any instruction from O.P. No.2 regarding full and final settlement of the loan amount.

After issuing N.O.C. it is the bounden duty of O.P. No.2 to issue necessary instruction to the O.P. No.1 for not deducting such amount w.e.f. the date of issuing N.O.C. but O.P. No.2 has failed to do so and so O.P. No.2 is liable to pay to the Complainant’s wife the said deducted amount of Rs.295/- at once.

The Commission is not inclined to pass any other order on compensation and litigation cost as it is an act of mis-communication and official irregularities between O.P. No.1 & 2

                  Hence it is ordered……..

That the case is disposed of on merit by directing the O.P. No.1 to stop henceforth the deduction of Rs.295/- from the account of the Complainant’s wife and refund the amount of Rs.295/- already deducted to the account of the Complainant’s wife at once.

O.P. No.2 is directed to give necessary instruction to O.P. No.1 in the matter.

The Complainant is directed to communicate the order to the O.P. No.2 immediately.

Both parties be supplied copy of this judgement free of cost.
