ORDER
PER SANJEEV BATRA, PRESIDENT
1. The complainant has invoked the jurisdiction of this Commission by raising a consumer dispute against the OPs with regard to repudiation of mediclaim insurance claim against the policy No.P/161114/01/2021/008748 with validity period from 19.03.2022 to 18.03.2023 by the OPs qua the expenses incurred upon his treatment to the tune of Rs.60,000/- approximately. So, by filing the present complaint, complainant has prayed that OP be directed to reimburse the expenses incurred by the complainant on his treatment along with Rs.1 lac as compensation and litigation charges etc.
2. Upon notice of the complaint, Sh.Rajeev Abhi, Advocate has appeared on behalf of OPs and filed power of attorney. Further, he has produced the copy of mail dated 31.05.2023 received from the office of OPs whereby he has been authorized to give statement qua the settle/compromise the case upto Rs.58,555/- to the complainant. In this regard, he has also suffered statement to the effect that he has received the email dated 31.5.2023 whereby the company is ready to pay Rs.58,555/- to the complainant in full and final settlement of the claim and redressal of the grievance of the complainant filed through the present complaint. The company will make the payment within 30 days from the receipt of copy of the award. Copy of the proposal/mail dated 31.01.2023 has been placed on record as Ex.CX.
3. The said offer has been duly accepted by counsel for the complainant by suffering separate statement in this regard. Further, he has prayed if the OPs failed to pay the settled amount within 30 days, then interest @8% per annum may kindly be granted to the complainant.
4. In view of the aforesaid settlement arrived between the parties through Ex.CX, the present complaint stands disposed of with the direction that the OPs will pay Rs.58,555/- to the complainant in full and final settlement of his claim within 30 days from the date of receipt of copy of this order, failing which, they will be liable to pay the interest @8% per annum to the complainant from the date of this order till realization. Copy of the order be supplied to the parties free of costs.
5. File be indexed and consigned to record room.
