Heard Mr. M.J. Baruah, learned counsel, appearing for the petitioner in the Misc Case for condonation of delay. Also heard Mr. R. Hazarika, learned counsel appearing for the respondent.

             This is an application for condonation of delay of 26 days in preferring the connected appeal. An objection in the form of an affidavit has been filed by the respondent by pointing out certain irregularity in the condonation petition and these irregularities are admitted by the learned counsel appearing for the petitioner.  Be that as it may, the delay is only 26 days and the explanation given in para 3, 4 and 5 are found satisfactory. Accordingly, the delay of 26 days is hereby condoned despite the application suffers certain irregularity as observed earlier.

               Misc Case stands disposed. The cost ordered earlier, has been paid by the petitioner and the same is received by the respondent. In view of disposal of this Misc Case, Registry shall allot a number to the pending appeal and the same shall be listed on 20-1-2014.
