Complainant files hazira through advocate.
No step is taken by the O.P. who is found absent on repeated call.
The case is fixed for w.v. I/D ex-parte hearing.
Accordingly the case is taken up for ex-parte hearing.
The Complainant’s case is that Complainant No.1 being a Senior Citizen along with his wife Complainant No.2 entered into an agreement dated: 03/01/2012 with the O.P./Builders for purchase of a self-contained shop on the ground floor of the flat as described in the schedule of the agreement of sale for Rs.6,93,000/- and after payment of Rs.6,13,000/- the Complainant did not get delivery of the shop within the stipulated time as per agreement of sale. O.P./Builders however returned back the money of Rs.1,25,000/- to the Complainant No.1 by three installments i.e. Rs.50,000/- on 15/11/2019, Rs. 50,000/- on 07/04/2021 and Rs.25,000/- on 30/09/2023. Thereafter the Complainant No.1 sent a letter dated: 05/10/2023 to the O.P./Builders by post with the reminder for refund of the balance amount of Rs.4,88,000/- (Rs.6,13,000/- minus Rs.1,25,000/-) and without getting any reply and payment of balance money the Complainant has filed the instant case on 17/11/2023 for refund of the said unpaid money together with compensation and litigation cost.

Though the O.P./Builders made their appearance before this Commission by filing Vokalatnama but he did not prefer to file any written version to contest the case.
The Commission has gone through the entire case of the Complainant and perused all the materials on record including the agreement of sale. Prima-facie case is established. The Complainant is entitled to get refund of the balance unpaid money of Rs.4,88,000/- and they are not entitled to get any compensation in this case as they have not cleared the payment of entire consideration money but instead received back the part payment thereof without any demand for getting delivery of the shop. However the Complainants are entitled to get Rs.12,000/- as cost for delayed payment.
Hence it is ordered…….
That the case be and the same is allowed Ex-parte against the O.P./Builders with cost of Rs.12,000/-.
The O.P./Builders is directed to pay to the Complainant Rs.4,88,000/- with cost of Rs.12,000/- within one month from this date in default law will take its own course.
Both parties be supplied copy of this Order free of cost.
