Brief facts of the case:-
Case in hand is the allegation of deficiency in service and unfair trade practice by the O.Ps for non replacement of Samsung mobile model No. SM-A217FZBGINS, IMEI No. 35536311863883 which the complainant sought redressal.
Upon notice the O.Ps put in their appearance through their learned counsel and filed written version in which they refuting allegation made against them. The O.Ps taking one and another pleas in the written version & pray to dismiss the complaint as it is not maintainable in the C.P. Act. The facts which are not specifically admitted may be treated as denial of the O.Ps. Hence the O.Ps prays to dismiss the case against them to the meet ends of justice.
Heard arguments from the learned counsel for the O.Ps and from the complainant. Perused the record, documents, written version filed by the parties.
The complainant is present during the course of hearing and submitted that from the date of purchase the OPs have not given proper service to the above set. Hence the O.Ps be directed to give proper service and replace the defective parts with out charging price and extend one year fresh warranty .
The complaint petition is allowed in part.
To meet the ends of justice the following order is passed.
O R D E R
In resultant the complaint petition stands disposed off on contest against the O.Ps.
The O.P. No.2(Manufacturer) is directed to remove all the defects of Samsung mobile model No. SM-A217FZBGINS, IMEI No. 35536311863883 including replacement of defective parts if any free of cost enabling the complainant to use the same in perfect running condition like a new one if the the complainant approached the O.Ps to rectify the defect of his set and shall provide all sort of after sale service to the complainant as per the terms and conditions of the warranty of the aforesaid set with extended further six months fresh warranty.
The O.P No. 1 (Dealer) is ordered to refer the matter to the O.P. No. 2 (Manufacturer) for early compliance of the above order and co-operate the complainant for better co-ordination with the O.P. No.2 (Manufacturer) to provide satisfying service for which he is entitled.
The entire directions shall be carried out with in 30 days from the date of receipt of this order. Parties are left to bear their own cost.
Miscellaneous order if any delivered by this commission relating to this case stands vacated.
A copy of this order be provided to all the parties at free of cost as mandated by the Consumer Protection Act, 2019 or they may download same from the confonet.nic.in to treat the same as if copy of order received from this Commission.
The judgment be uploaded forthwith on the website of the Commission for the perusal of the parties.
File be consigned to the record room along with a copy of this Judgment.
