ORDER ON MAINTAINABILITY

     This is a misconceived complaint filed U/s. 12 of the C.P. Act. before us.  Several opportunities have been granted to the complainant’s side to justify the maintainability of the case but, to no avail, albeit the O.P. has remained absent and placed exparte.

2.            It is the say of the complainant that, he has been a dealer for M/s Hero Motors and being interested to augment his business in Aurad Taluk of Bidar District, got the O.P. appointed as his representative, a business agreement was executed between them and in course of business the O.P. owes a sum of Rs. 6,86,756/- to the former.  The complainant claims a recovery of the said sum through this Forum.

3.           Hence, primafacie, this is a case between two business entities regarding enforcement of the terms of the a contract.  None if a consumer as defined U/s 2(1) (d) of the C.P.Act. to the counter part and hence the present case, in the present form is not maintainable in this Forum.

4.              Accordingly, we dismiss the present complaint, without delving further into the documents before us.  There would be no order as to costs.
