Hazira filed by the complainant who is personally present.
No step is taken by the O.P.
The case is fixed for argument.
After hearing the arguments the Commission proceeds to dispose of the case as hereunder: -
The Complainant’s case is that one Sunanda Khandelwal originally purchased 16 nos. potato Bonds No. being 1084 to 1086, 1093 to 1100, & 1088 to 1092 on 20-03-2016 from the O.P. for storage of 3,200 Bags of potatoes weighing 50 kg. per Bag valued at Rs.500/- per Bag. Thereafter those Bonds were transferred to the Complainant on 05-06-2016 with proper endorsement on the Bonds. The Complainant approached the O.P. for return of the stored potatoes in due time but he could not get it as it was sold in the Market for Rs.16 Lakhs. The O.P. neither returned the bonded potatoes nor refunded the sale proceeds of Rs.16 Lakh.
The Complainant being Transferee Bond holder is a Consumer for commercial purpose within the meaning of explanation to the definition of consumer under Section 2 (7) of Consumer Protection Act, 2019 as there is no material on record to establish other income, business, profession or occupation of the Complainant.

The Complainant has therefore prayed for appropriate relief.
The O.P. contested the case by filing a written version denying all the material allegations in the complaint without making any specific defence.
Having regard to the complaint, written version, submission and documentary evidence on record the Commission finds that the Complainant is entitled to get the return of stored potatoes or to get the sale proceeds thereof to the tune of Rs.16 Lakh after deduction of rents of the storage if any. It is the duty of the O.P. as the Cold Storage authority to abide by the terms and conditions of the Bonds and violation thereof amounts to deficiency in service.
The case therefore succeeds.
Hence it is ordered……
That the case be and the same is allowed on contest against the O.P.
The O.P. is directed to pay to the Complainant Rs.16 Lakh as the value of the stored potatoes under Bonds within two months from this date failing which the decretal amount may be realized through Execution process.
Both parties be supplied copy of this Order free of cost.
