Ld. Advocate for the Appellant is present.  The Misc. Application bearing No. 173/2019 is taken up for hearing.  By this application the Appellant has prayed an order allowing refund of the statutory deposit made at the time of filing the Appeal.  It appears from the judgment dated 30.4.2013 passed in FA/65/2012 that the Appeal was allowed, the impugned judgment was set aside and the petition of complaint was dismissed.  Under the circumstances, we allow the Misc. Application.  The Appellant is at liberty to withdraw the statutory deposit made at the time of filing the Appeal.  The Registrar of this Commission will do the needful in the matter after observing all necessary formalities.  The Misc. Application is thus disposed of.
