          Parties file hazira. The case record is taken-up for hearing of the petition dated 07/02/2019 filed by proforma O.P. no. 4 praying for expunging his name from the petition of complaint.

          The said petition is taken-up for hearing. Perused the said petition and the case record. Heard Ld. Lawyer of both sides.

Considered.

          It appears from the petition of complaint that these is no allegation regarding deficiency in service in the petition of complaint against this O.P. no. 4 and no relief has been sought for against O.P. no. 4.

          In view of that, O.P. no. 4 is unnecessary party in the CC178/2018 and therefore the name of the O.P. no. 4 should be expunged.

         Hence,

                   it is

O R D E R

          that the petition dt. 07/02/2019 is allowed on contest but without any cost.

          Let the name of O.P. no. 4 be expunged from the petition of complaint case no 178/2018.

          MA case no 17/2019 is disposed of accordingly.
