Krishan Singh vs. SREI Equipments.

 

Present: None for complainant.

              Sh.Ashwani K Batra, Adv. for opponents.

               

                                   Again complainant has not appeared, either in person or through any Advocate. The complaint cannot be dismissed, on account of default in appearance as envisaged under section 38 of the Consumer Protection Act, 2019.  So, having no another alternative, this Commission proceeds ahead to decide the application dated 8.7.2022 filed by the opponent.

                                Heard the counsel for the opponents. By way of this application, the counsel for the opponent-applicant submitted, the National Company Law Tribunal vide its order dated 8.10.2021 in CP (IB) No.294 of 2021 imposed moratorium as envisaged under section 14 of the Insolvency & Bankruptcy Code, 2016.  In view of enforcement of moratorium, the further proceedings against the opponent are not permissible at this stage.  The application dated 8.7.2022 filed by the opponents is accepted and further proceedings at this stage are closed and proceedings are adjourned sine-die and may be revived at any subsequent stage on the application of any of the parties to the proceedings.
