ORDER

     Report of the office seen. No stay order has been received. Notice to OP/JD be issued for compliance. 

     At this stage, Sh.Sachin Midha, Branch Service Coordinator of OP/JD put in appearance and accepts notice on behalf of OP/JD. He has handed over a cheque of Rs.83,831/- to the complainant, which the complainant has received and suffered separate statement that he has received a cheque of Rs.83,831/- bearing cheque No.801901, dated 26.05.2017 in his favour drawn on Standard Chartered Bank from Sh.Sachin Midha, Branch Service Coordinator of OP/JD today in compliance of the order dated 17.02.2017 passed by this Forum in CC/603/2016. He has further stated that he shall return the defective Home Theatre in question complete in all respects to OP/JD today itself and hence he withdraws this complaint subject to realization of the said cheque. At this stage, Sh.Sachin Midha, Branch Service Coordinator of OP/JD suffered a statement that he has gone through the statement made by complainant/DH. Consequently, instant execution application is dismissed as withdrawn subject to realization of aforesaid cheque. Complainant/DH shall remain bound by his statement.

     Certified copies of this order be sent to the parties free of cost. The file be consigned.
