Today is fixed for admission hearing.

Ld. advocate for the applicant side is found present and ready. 

OP also appeared and raised verbal objection.

Heard both sides  considered submission.

Perused the MA application which has been filed for setting aside ex parte order which is passed by this District commission in CC-204/23.

After going through the material of this case record it is revealed that the OP has filed the written version of the above noted complaint case after completion of statutory period.  There is no explanation of delay.  Moreover, in view of the decision passed in the case of New India Assurance Company Vs. Hilli Multipurpose Cold storage Pvt. Limited Hon’ble Apex court has been pleased to observe that no w/v can be accepted after the completion of statutory period of time.

Considering all the above noted factors this District Commission is of the view that this MA case cannot be admitted.

So it is dismissed on contest.   No order is passed as to cost.
