Ld. Counsel for the Petitioners brings to our attention the Order of the SCDRC, Madhya Pradesh dated 29.07.2024 (page 13) where their Appeal No.1854 of 2023 was dismissed in default due to the Appellant’s absence. The Order also states that the Appellant was absent on 19.03.2024 and 03.06.2024, as well.

Ld. Counsel for the Petitioners states that their absence was on account of a human error on part of their Counsel, who was although present in the Court during the day, but somehow when the case came up for hearing, they were not present in the Court room.

In the interest of Justice, the Revision Petition is allowed and the Appeal No.1854 of 2023 is restored and remanded back to the Ld. State Commission to be decided on merits after hearing both the parties.

          Parties shall appear before the Ld. State Commission on 25.11.2024.

However, because the Appellants have been absent on three consecutive occasions before the SCDRC, a cost of Rs.10,000/- may be imposed upon them to be deposited before the SCDRC on or before the next date of hearing.
