| Final Order / Judgement | The matter is placed before the National Lok Adalat. Learned counsel for both the parties are present. OP No.1 & 2 –financer is absent inspite of notice. They submit that the matter should be settled in National Lok Adalat. It is agreed between the parties that OP No.3 & 4 would pay Rs.2,67,715/- which the surveyor has complied loss instead of Rs.4,96,029/- and they further agreed that compensation of Rs.1,00,000/- should be reduced to Rs.50,000/-. They also agreed that cost of Rs5,000/- will be paid by the OP to the complainant. In view of aforesaid submission and agreement, the operative portion of the impugned order is modified to the extent that OP No.3 & 4 would pay Rs.2,67,715/- to the complainant as the financer remained absent in the proceeding and also OP No.3 & 4 would pay Rs.50,000/- towards compensation for his mental agony and Rs.5000/- towards cost to the complainant. All these payment should be made within 45 days from today,failing which all these payment would carry interest @ 12 % from the date of impugned order till payment is made. The appeal is disposed of accordingly in National Lok Adalat. | |
