Hon’ble Mr. Ajeya Matilal, Presiding Member
Ld. Counsel appearing for the Revisionist/Petitioner is present.
Being aggrieved by and dissatisfied with the Order no. 2 dated 28.10.2022 rejecting the Misc. Application filed by the OP No. 1 with contest with cost of Rs. 5,000/-, the Revisionist/Petitioner/OP preferred this Revision Petition.
The main grievance of the Revisionist/Petitioner is that the OP No. 1 is not required to be added as a necessary party. She also submitted that she is not required to pay any cost as imposed by the Ld. Commission below.
Heard.
Considered.
We find the OP No. 1 is a necessary party to the complaint case for proper adjudication of the dispute between the parties because the OP No. 1 was the Chairman of LICI. But we think the cost imposed may be waived. Ld. Counsel concerned submitted that all correspondences were made in between the Complainant and the Divisional Office.
Hence, it is,
O R D E R E D
That the Revision Petition is allowed.
The cost imposed to the extent of Rs. 5,000/- upon the OP No. 1 (Chairman of LICI) is waived. But, we find that the OP No. 1 is a necessary party to the proceeding.
Fix 15.01.2025 for appearance of the parties before the Ld. Commission below.
The Ld. Commission below is requested to dispose of the case in accordance with law.
Let a copy of this Order be sent down to the Ld. Commission below.
Revision Petition being no. 156/2022 stands disposed of.
Note accordingly.
