FINAL ORDER / JUDGEMENT

Both parties file hazira through Advocate.

The case is fixed for hearing of the petition dated: 10/07/2024 filed by the Dhr. for attachment of property of Jdr.

Written Objection is filed by the Jdr. stating that the proposed property under attachment as is evident from the Letter No.1968 RC-55/S/2014-Kol, dated: 25^th July, 2019 issued by Superintendent of Police, C.B.I., EO-IV-Kol addressed to Nodal Officer of the Hon’ble Justice S P Talukdar Committee is also within the purview of the attachment proceeding before the Hon’ble Justice S P Talukdar Committee and as such this executing Court cannot enforce the execution of the Order dated:20/02/2024 passed by this Commission in CC/34/2023.

Dhr. is directed to exercise the liberty given in the said Final Order dated: 20/02/2024 to approach the Hon’ble Justice S P Talukdar Committee constituted by the Hon’ble High Court, Calcutta for recovery of the decretal amount unless and until directed otherwise by Hon’ble Justice S P  Talukdar Committee.

The Execution case is accordingly disposed of.

Both parties be supplied copy of this Order free of cost.
