Today the case is fixed for compromise before Pre National Lok Adalat. Compromise not effected.
Complainant alongwith his counsel has suffered his separate statement to the effect that he has paid an amount of Rs.1,50,000/- under pressure of the OP and OP had issued NOC. The loan amount has been disbursed in his account on 18.06.2021 but OP has started to deduct the installments of loan from 05.11.2020. Hence, he withdraws the present complaint and reserve his right to file fresh complaint against the OP qua the excess interest charged by the OP and on account of harassment suffered by him. The time period consumed during the pendency of the present complaint may kindly be exempted.
In view of the above statement, the present complaint is hereby dismissed as withdrawn. However, the complainant is at liberty to file fresh complaint with regard to his grievances, if so desired. In view of the law laid down Hon’ble Supreme Court in Laxmi Engineering Works Vs PSG Industries Institute (1995) 3 SCC 583, the complainant will be entitled to get the benefit of provisions of Section 14 of the Limitation Act, to exclude the period spent in prosecuting the present complaint, while computing the period of limitation prescribed for filing such before the competent Court of Law. The parties concerned be communicated of the order accordingly and file be consigned to the record room after due compliance.
