Heard the learned counsel for the petitioner and the respondent caveator for some time. At this stage the learned counsel for the petitioner seeks to withdraw the revision petition with liberty to the petitioner and his wife Smt. Vandana Tripathi to work out their remedy before the competent Court or Forum in accordance with law. We accordingly dismiss the revision petition with liberty as aforesaid to the petitioner and his wife Smt. Vandana Tripathi. In doing so, the petitioner and the aforesaid Vandana Tripathi may take advantage of the decision of the Supreme Court in the case of Laksmi Engineering Works vs P. S. G. Industrial Institute ( 1995) 3 SCC 583 so far as the question of limitation and exclusion of the time spent in the proceedings before the Consumer Fora is concerned. Counsel for the respondent states that he will not press the order relating to award of cost only.
