1. None for the appellant is present though the appeal is called at 2.30 p.m.
2. Advocate Mr J C Shukla is present for respondent Nos.1 & 2 and he submitted that the appellant neither filed Written Notes of Arguments though several chances have been given by this Commission nor appeared on last date and today also for final hearing. He, therefore, requested that the appeal may be dismissed in default.
3. We have perused the entire record & proceedings of the appeal. The appeal was admitted by this Commission as per order dtd.12.11.2014. On that date direction was given to both parties to file Written Notes of Arguments. It is seen that eighteen adjournments have been granted to the appellants till this date for filing Written Notes of Arguments since 12.11.2014.
4. Moreover, this Commission also granted last chance to the appellant on 09.01.2018 for filing Written Notes of Arguments. However, till this date the appellant failed to file Written Notes of Arguments.
5. Moreover, on last date i.e. 22.03.2018 and today also despite of granting last chance the appellant failed to appear for final hearing and hence the appeal deserves to be dismissed in default.
Accordingly, the appeal is dismissed in default.
No order as to costs in this appeal.
Copy of the order be furnished to both parties free of cost.
