Heard Mr. Naresh Maimom, learned counsel appearing for the petitioner also heard Mr. K. Bimolchand Singh, the respondent No. 1 in person. The presence of respondent No. 2 was recorded on 12.02.2016, but today, no one is present on behalf of the Proforma respondent No. 2.

This is an application for condonation of 12 days’ delay in preferring the connected appeal. Mr. Bimolchand, the principal respondent has been asked whether he would like to file an objection to the prayer for condonation of delay. To this, Mr. Singh has submitted that he will not file any objection as he does not want to keep this matter pending for long.

We have perused the explanation given in para Nos. 3, 4 and 5 of the condonation petition and we are satisfied with the explanations. Accordingly, delay of 12 days is hereby condoned and the Misc. Case stands disposed. In view of disposal of the Misc. Case, the appeal shall be listed for admission on 29.02.2016.
