 Advocate Mr.Upendra Joshi appeared for the appellant and he filed a pursis stating there in that the dispute has been amicably settled in between the appellant and the respondent out of this Commission and the appellant wants to withdraw the appeal. In view of the aforesaid submission made before us by advocate Mr.Upendra Joshi, permission is granted to the appellant to withdraw the appeal. The appeal is therefore dismissed as withdrawn. The appellants’ advocate submitted that direction may be given to the Additional District Consumer Forum Nagpur to refund the amount deposited by the appellant with the said Forum during the pendency of appeal as the appellant already paid the entire awarded amount to the respondent. However respondent shall move the said application alongwith the necessary documents before the Additional District Consumer Forum Nagpur showing that the appellant already complied with the impugned order. Upon receipt of that application the Additional District Consumer Forum Nagpur will at liberty to pass an appropriate order on the said application. Copy of order be furnished to both parties free of cost.
