Both parties file hazira through advocate.
The case is fixed for argument.
After hearing argument from both sides the Commission proceeds to dispose of the case as hereunder: -
The Complainant’s case is that he is the registered owner of a Maruti Private Car No. being WB 68 K/5934 duly insured with O.P./Insurance Co. Policy No. being OG-22-2419-1801-00000659 valid from 25/01/2022 to 24/01/2023. On28/12/2022 the Complainant while driving the car himself got the car caught fire on Ekteswar Bridge within the jurisdiction of Bankura and the concerned Fire Officer submitted report on 30/12/2022 citing the cause of fire as electrical short circuit. Due intimation was given to the O.P./Insurance Co. accompanied by claim application but the same was not accepted for the reason best known to the O.P./Insurance Co.
O.P./Insurance Co. contested the case by filing a written version contending inter alia that the Complainant is not entitled to get any relief in this case as the accidental fire took place due to contributory fault of the Complainant for extra inbuilt electrical fan fitment with LFG CNG kit into the car.

-: Decision with reasons: -
Having regard to the facts of the case, submission, contention and documents from both sides the Commission finds that IDB value of the car is Rs.1 Lakh as in 2012 and the Surveyor’s report submitted by the O.P. has assessed the loss and damage at Rs.43,886/- after taking into account the depreciation. The Complainant has produced proper valid Driving License at the time of hearing. The Commission finds no reason why such assessed damage was not offered to the Complainant in due time.
Taking into account the delayed disposal of the claim and contributory fault of the Complainant the Commission fixes the liability of the O.P./Insurance Co. at Rs. 60,000/- for the accidental damage of the car.
Hence it is ordered……..
That the case be and the same is allowed in part on contest.
The O.P.No.1/Insurance Co. is directed to pay to the Complainant Rs. 60,000/-as compensation for the damage car within one month from this date in default law will take its own course.
Both parties be supplied copy of this Judgement free of cost.
