                Sh. Narender Kumar, counsel for the JD.

                                                              

                  Today the execution application is fixed for consideration.

                  At this stage, learned counsel for the DH has suffered his separate statement to the effect that, he does not want to pursue with the present execution application further being partly satisfied and withdraws the same with liberty to file fresh execution application.      

      In view of the above statement the present execution is hereby dismissed as withdrawn. However, the DH is at liberty to file fresh execution application on the same cause of action Parties concerned be communicated of the order accordingly and file be consigned to the record room.
