Case was fixed for arguments. Today the counsel for the OPs No. 1 & 2 offered to settle the claim of the complainant involve in the present complaint at Rs. 6,78,000/- as full and final settlement of the claim subject to the NOC supplied from the Financier if any alongwith the affidavit by the insured/ complainant regarding the clearance of loan as well as cancellation registration certificate of the vehicle bearing No. PB09Y 8945 from the concerned RTO. The salvage will be retained by the insured/ complainant. The amount of the claim shall be paid within 35 days from the date of receipt of the certificate of cancellation of registration certificate. In this regard, counsel for OPs No. 1 & 2 recorded his statement separately for compromise. Sh. Jaswinder Singh complainant alongwith counsel Sh. Munish Luthra Advocate also present and accepted the offer given by the OPs No. 1 & 2 and recorded his separate statement before this Commission. In view of the statements made by both the parties today in this Commission, the complaint is disposed off with the direction to the OPs No. 1 & 2 that they shall pay Rs. 6,78,000/- as full and final settlement of claim subject to the NOC supplied from the Financier if any alongwith affidavit by the insured/complainant regarding the clearance of loan if any as well as cancellation certificate of the registration of vehicle bearing No. PB09Y8945 from the concerned RTO. The salvage will be retained by the insured/complainant as per statement of the OPs No. 1 & 2. The amount of the claim shall be paid within 35 days from the date of receipt of above said documents as per statement of both the parties. Otherwise the OPs No. 1 & 2 shall be liable to pay interest @6% per annum on Rs. 6,78,000/- beyond the period of 35 days of receipt of above said documents from complainant. Both the parties shall remained bound by their statement. Original documents, if any, be returned to the counsel for parties against proper receipt. Copies of order be supplied to the parties free of costs. File be consigned to the record room.
