None is present for the appellant. Adv. Ms A P Sole appeared for the respondent and filed her power.  She submitted that appellant has not furnished appeal compilation to the respondent. 

 

It is seen that the respondent has been already proceeded exparte on 16.12.2015. The appellant was directed to file Written Notes of Arguments on next date. The appeal was thereafter adjourned thrice i.e. on 12.02.2016, 18.04.2016 & 20.06.2016.  However, Written Notes of Arguments are not filed by the appellants and none appeared for the appellant.

 

Today also none appeared for the appellant till 1.00 p.m. Therefore, we find that the appeal deserves to be dismissed in default.

 

Hence, the appeal is dismissed.

No order as to cost.

Copy of the order be furnished to both parties free of cost.
